The Virginia Lottery Board is implementing stricter consumer-protection rules for mobile sportsbooks and online casinos. The regulations, set to take effect on October 22, 2025, aim to enhance protections for sports bettors in multiple areas.
Protecting Young Betting: New Advertising Restrictions
The regulations place significant restrictions on advertising to minors. Permit holders, which include sportsbook operators, are now prohibited from directly targeting individuals under 21 with sports-betting advertisements or promotions. Furthermore, ads cannot feature images, symbols, celebrity endorsements, or language designed to appeal to minors, nor can they depict anyone who appears to be under 21, except for pro athletes who are minors. This extends existing rules, such as the ban on depicting minors, students, schools, or school settings in sports-betting ads.
Ads must also clearly state the minimum legal age to participate and include a responsible-gaming message displaying the toll-free number for the National Problem Gambling Helpline, along with an assistance message. Permit holders must communicate this information on websites, mobile apps, and other marketing channels, with limited exceptions for certain media.
In addition, permit holders must ensure that advertisements accurately represent winnings and do not mislead bettors about gambling outcomes or odds. Ads are considered misleading if they present average winnings without also providing average net winnings with equal prominence.
The updated rules expand on existing regulations in 11VAC5-80-150, which already require ads to disclose the permit holder's identity, prohibit minors from influencing sports-betting choices, prevent using characteristics of at-risk bettors to target such individuals, and mandate that ads convey information on assistance for at-risk bettors.
Consumer Recourse: Enhanced Complaint Procedures
The regulations also establish detailed complaint-handling protocols. Every permit holder must publish procedures allowing sports bettors to file complaints, and permit holders must respond to all complaints within 15 days, either granting relief, denying relief with a specific explanation, or requesting additional information. If further information is needed, the operator's response must specify the type of information required, and the complaint must be resolved within seven days of receiving that data.
Operators must retain all complaints and related emails or live-chat transcripts for at least four years and make them available to the Virginia Lottery within seven days of a request. These rules aim to provide fair, transparent, and accessible avenues for bettors to register concerns and seek resolution.
Built-in Responsible Gaming Tools
The regulations also mandate the availability of built-in responsible-gaming tools, such as self-exclusion and time-out periods, for all players using account-based gambling systems.
Existing Virginia law mandates that the Lottery Board implement a self-exclusion program for account-based gambling, including sports betting. This program requires permit holders to suspend wagers and reverify a player's identification if there is any suspicion of compromised player identification or account activity, addressing common concerns about online gambling risks. Players can also order a temporary "cooling-off" period by requesting an account suspension for at least 72 hours, providing a short-term option for players seeking to limit their gambling.
Likewise, the lottery law demands that credibly licensed retailers prominently display the legal gaming tip line phone number and the National Problem Gambling Helpline on readily visible signs, reinforcing the importance of responsible advertising in the context of sports wagering and casinos.
Evolving Landscape: Gaming Influencers and Digital Gaming
Further, as online and mobile options become more popular, the Virginia Lottery Board has publicly expressed concerns over youth exposure to gambling, mentioning that they’re investigating the growth of gaming influencers, unregulated apps, and their negative effects on younger players. They are collaborating with other state agencies to develop effective strategies to safeguard consumers in the increasingly digital world of gambling.
The regulations also include specific requirements for on-premises mobile casino gaming, ensuring that only individuals physically present on the casino property can place wagers through a mobile casino platform. Operators must verify the presence of the player on-premises, implement geolocation controls, and retain transactional data as part of these regulations.
These provisions aim to enhance the transparency, accountability, and safety of mobile casino gambling, bringing it in line with established consumer protection standards.
In summary, the Virginia Lottery Board's updated regulations introduce a comprehensive set of protections for sports bettors in the mobile and online gambling sphere. The changes address concerns about youth exposure, misrepresentation, fraud, and problem gambling, and establish clear standards and guidelines. As the gambling industry continues to evolve in the digital age, these regulations represent a significant step towards ensuring a safe, transparent, and consumer-friendly gambling environment in Virginia.
